These Terms of Service ("Terms") govern your use of https://wildflowernh.com and any related services offered by Wildflower Ceramics (collectively, the "Services"). By accessing the Services or placing an order, you agree to these Terms. If you do not agree, do not use the Services.

1. Online store terms

You must be legally capable of entering into a binding agreement in your jurisdiction to make a purchase. You may not use the Services for unlawful, fraudulent, or abusive purposes or interfere with the operation or security of the Services.

Our store is hosted by Shopify, which provides the ecommerce platform that allows us to offer products and services to you.

2. Products and made-to-order production

Many Wildflower Ceramics products are made to order by independent production partners. Product availability, production locations, materials, colors, dimensions, and designs may change. Slight variations in color, image placement, scale, or appearance may occur because of screen settings and the nature of print-on-demand production. These reasonable variations are not defects.

We make reasonable efforts to display products accurately, but we cannot guarantee that every device will display colors or details exactly as they appear on the finished product.

3. Orders

Your order is an offer to purchase. We may accept, decline, limit, or cancel an order for reasons including product availability, pricing or description errors, suspected fraud, payment problems, or shipping restrictions. If we cancel an order after payment, we will issue a refund for the canceled amount.

You are responsible for providing accurate billing, payment, contact, and shipping information. Order changes and cancellations are not guaranteed once production begins.

4. Prices and payment

Prices are shown in the currency displayed at checkout and may change without notice. Taxes, shipping charges, customs duties, and other applicable charges may be added at checkout or assessed by the destination country. Payment must be authorized before an order is processed.

5. Shipping and delivery

Production and delivery dates are estimates and are not guaranteed. Carrier delays, customs processing, severe weather, supply interruptions, and other events outside our control may affect delivery. Our Shipping Policy is incorporated into these Terms.

6. Returns, replacements, and refunds

Returns, replacements, cancellations, and refunds are governed by our Refund Policy, which is incorporated into these Terms. Made-to-order items generally cannot be returned or exchanged for buyer's remorse or an incorrectly selected size, color, or design, except where required by law.

7. Intellectual property

The Services and their content, including designs, artwork, photographs, text, graphics, logos, product names, and site presentation, are owned by or licensed to Wildflower Ceramics and are protected by applicable intellectual-property laws. You may use the Services for personal, non-commercial shopping purposes only. You may not copy, reproduce, modify, distribute, sell, or exploit our content without prior written permission.

8. Reviews and submitted content

If you submit a review, photograph, comment, suggestion, or other content, you represent that you have the right to provide it and that it is accurate, lawful, and does not violate another person's rights. You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display that content in connection with our business and marketing, subject to applicable law and our Privacy Policy.

9. Prohibited uses

You may not use the Services to violate law; infringe intellectual-property or privacy rights; transmit malicious code; collect information about others without authorization; impersonate another person; submit false or misleading information; interfere with security or operation; or attempt unauthorized access to the Services or related systems.

10. Third-party services and links

The Services may contain tools, applications, or links provided by third parties. We do not control third-party services and are not responsible for their content, availability, or practices. Your use of a third-party service may be subject to separate terms and policies.

11. Privacy

Our collection and use of personal information are described in our Privacy Policy.

12. Disclaimers

To the fullest extent permitted by law, the Services and site content are provided "as is" and "as available." We do not guarantee uninterrupted or error-free access. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

13. Limitation of liability

To the fullest extent permitted by law, Wildflower Ceramics and its owners, employees, service providers, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Services or products. Where liability cannot be excluded, our total liability will not exceed the amount paid for the product or order giving rise to the claim. These limitations do not apply where prohibited by law.

14. Indemnification

To the extent permitted by law, you agree to indemnify and hold Wildflower Ceramics harmless from claims, liabilities, damages, and reasonable expenses arising from your unlawful misuse of the Services, your violation of these Terms, or your infringement of another person's rights.

15. Severability and waiver

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. A failure to enforce any provision is not a waiver of the right to enforce it later.

16. Governing law

These Terms are governed by the laws of the State of New Hampshire and applicable federal law, without regard to conflict-of-law principles, except where consumer-protection law requires otherwise.

17. Changes to these Terms

We may update these Terms by posting a revised version with a new "Last updated" date. Changes apply prospectively unless applicable law requires otherwise.
